Refunds For 1-, 2-, and 3-Family Home Filing Fees

Last year, NYC Buildings announced a new, more equitable, fee structure for DOB filings, the first such change in over a quarter century. As part of the restructuring, one-, two-, and three-family New Building and Alteration filing fees were reduced by half, a change that went into effect on 1/17/17. Applications for these types of projects that were filed between 6/9/16-1/16/17 may be eligible for a refund to reflect the new reduced filing fee structure.

New Construction Superintendent Rule

Reminder that the Department is conducting random site visits to enforce compliance with the recently-revised Construction Superintendent Rule (1 RCNY 3301-02) and May 2016 Industry Notice.

The Department strictly enforces the Construction Superintendent Rule, failure to comply with the new rule changes can lead to revoked permits, Full Stop Work Orders, ECB violations and fines issued directly to the Registered Construction Superintendent, as well as to the permit holder.

Disciplinary Cases

The Department issued a civil penalty of $1,600 to a Licensed Master Plumber after it was determined that he had 74 denials of inspection requests within a 7 month period, 43% of his total requests. The reasons for the denial range from missing gas roughing to missing FDNY documentation.

Hoisting Machine Operators Amendment

1 RCNY 104-09 (effective 03.02.17) The amendments reflect the New York State Supreme Court's decision that the portion of the current rule relating to out-of-state experience in an urban area of comparable density for a Class A Hoisting Machine License is invalid.

Buildings Penalty Schedule Amendment

1 RCNY 102-01 The Department of Buildings (DOB) proposes to relocate the DOB Penalty Schedule from the Office of Administrative Trials and Hearings Environmental Control Board (OATH ECB) rules in Chapter 3 of Title 48 of the Rules of the City of New York to DOB's rules in Chapter 100 of Title 1 of the Rules of the City of New York. OATH ECB is proposing a companion rule repealing the DOB Penalty Schedule from its rules.
