Disciplinary Cases

A criminal summons was issued to a building owner in Brooklyn for violating a Stop Work Order issued by the Department. The Stop Work Order was issued for the illegal construction of a one-story extension behind the existing residential building without proper DOB permits.

$75,000 in fines was levied against a general contractor and a subcontractor for a failure to safeguard their construction site in Manhattan, and a failure to comply with a Commissioner’s Order to lower a construction crane during high winds.

DOB recently issued violations to 19 separate properties for illegal alterations done without DOB approval. The resulting civil penalties for these violations totaled over $360,000.

DOB issued multiple violations to the owner of a 6-story building in the Bronx for failure to file façade inspection reports in three successive cycles, as required by Local Law 11. DOB’s continual enforcement actions compelled the building owner to file the required façade inspection report for the building.

Reporting on Illegal Conversions

Local Law 87 of 2017 (effective 5/30/17) amends the Administrative Code of The City of New York, in relation to reporting on illegal conversions of dwelling units for other than permanent residence purposes.

Illegal Conversions

Local Law 94 of 2017 (effective 9/27/17) amends the Administrative Code of The City of New York, in relation to illegal conversions.

Water Pollution Control

Local Law 97 of 2017 (effective date contingent upon DEP rulemaking) amends the New York City Charter, the Administrative Code of The City of New York, the New York City Plumbing Code and the New York City Building Code, in relation to water pollution control, including provisions relating to stormwater management and control of discharges into storm sewers.

Reporting on Illegal Conversions

Local Law109 of 2017 (effective 5/30/17) amends Local Law 50 of 2015, relating to the preservation of certain hotels, a moratorium and report relating to such preservation, and the expiration and repeal of such amendments, in relation to extending the effective period of the provisions of such local law and requiring a supplemental report relating to such preservation.

New York City Housing Maintenance Code

Local Law 153 of 2016 (effective 6.4.17) amends the Administrative Code of The City of New York, in relation to requiring owners to provide notice to their tenants regarding procedures that should be followed when a gas leak is suspected.

Amendment of Rules Implementing Energy Code

Failure to secure a window air conditioner unit, or using blocks of wood, bricks or telephone books to prop up the AC unit, can result in violations from the Department.
