This legislation seeks to better ensure that imitation firearms are not mistaken for actual weapons. Specifically, this bill would prohibit the sale, use or possession of any toy or imitation firearm that is not either constructed entirely of transparent or translucent materials or designed in bright, distinct colors. The bill requires that barrels of imitation firearms be sealed and the name of the toy's manufacturer be legibly stamped on the imitation firearm. Furthermore, the sale, possession and use of toy or imitation firearms with laser pointers would be prohibited. Violators would face up to $1,000 in civil fines as well as criminal penalties of up to $1,000 and/or up to one year in prison.
The dangers of imitation firearms are well known, and the City has regulated their sale and possession since 1955. However, over the years, there have been incidents where children's toys have been confused for deadly weapons. In a time when it is not uncommon to hear of young people using real firearms to commit violent crimes, it is essential that we help law enforcement to delineate between real threats and harmless toys. By making the law's requirements regarding the sale and possession of imitation firearms stronger and clearer, this bill has the potential to save lives.
