Certification of No Harassment or Exemption Application

The City accepts applications for a Certification of No Harassment or Exemption if you own a single room occupancy multiple dwelling or a multiple dwelling in the following locations:

  • The Special Clinton District
  • The Special Hudson Yards District
  • Preservation Area P-2 of the Special Garment Center District
  • The Greenpoint-Williamsburg anti-harassment area
  • The Special West Chelsea District

You must have a Certification of No Harassment or Exemption from the City's Department of Housing Preservation and Development before you can receive a permit from the City's Department of Buildings to alter, demolish or change the shape or layout of the building. If a Certification of No Harassment is not issued, the owner may not obtain a permit from the Department of Buildings to alter or demolish the building. If such a Certification is issued, the owner remains subject to all other laws and regulations that relate to construction work in the building including the requirements of the Building Code, the Rent Stabilization Law, the Rent Control Law and the Real Property Law. Certification is valid for three (3) years.  A new application must be filed and approved to continue certification every three (3) years.
