Filing a Disciplinary Appeal with the CSC

Individuals who believe they have been improperly disciplined following a Civil Service Law Section 75 disciplinary proceeding should follow the instructions for appeal provided in the letter notifying the individual of the penalty being imposed by the agency head.

Appeals to the CSC must be filed within twenty (20) days after the agency head's final disciplinary decision. Appeals must include a copy of the letter notifying the appellant of the penalty being imposed by the agency. IMPORTANT: it is critical to meet the filing deadline even if all records and documents are not available for the appeal. No other supporting documents are necessary until after The Commission acknowledges your appeal.

Note: A disciplinary determination may be appealed to either the CSC or the Supreme Court. If you choose to file an appeal with the CSC, the CSC's determination is final and cannot be appealed to the Supreme Court, except in rare circumstances. If you choose to file your appeal at the Supreme Court, you will not be able to appeal that decision to the CSC.

Appellants (or their counsel) may submit appeals electronically directly to the CSC via the Internet Intake system. A valid email address is required to use the Internet Intake system, and appellants must continue to check their email daily after submitting an appeal.

Do not submit the same appeal more than once. When an appeal is received, the CSC will review it and respond with further instructions.
