Forgiving Fines: The NYC Amnesty Program is Now Closed!

The deadline for amnesty applications was December 12, 2016. However, if you received a notification on correcting one or more compliance violations and have completed all payments by the program’s end, you must continue to correct any compliance violations within 6 (six) months of receiving your compliance notice. If you do not correct the conditions by the end of this 6 (six) month period:

  • Your amnesty agreement will be cancelled
  • You will owe the full pre-Amnesty balance of the violation including interest and default penalty, if applicable, for each violation.
  • We will apply what you paid for the violation(s) to the balance owed but you may also be subject to enforcement.

You may continue to use the Contact Amnesty form to notify the NYC Department of Finance of your correction approval, however it is best to make sure the issuing agency has formally approved your correction.

What was “Forgiving Fines: The NYC Amnesty Program”?

The three-month program authorized by Mayor de Blasio and the City Council allowed participants to resolve violations they received from New York City’s Department of Sanitation, Buildings, Transportation, Fire Department, Landmarks, Parks or other City of New York agencies and which had gone into judgment.*

The program, run by the New York City Department of Finance (DOF), expired on December 12, 2016.
*Violations must have been in judgment to have been eligible for amnesty.  This means the City of New York took the legal step of filing a public record of your liability in court for the entire amount due. After the filing, interest accrued.  The Amnesty Program did not include parking violations, criminal violations or violations over $25,000. Other limitations, exclusions and eligibility requirements applied.

The Amnesty Terms and Conditions state that the full amount owed on all outstanding judgments will be due and payable. Payments you made during Amnesty are now considered partial payments towards the total amount owed. You may be eligible to get a settlement agreement to pay your other violations. The Amnesty Terms and Conditions states that the law requires that all eligible judgment for all properties you own be paid under Forgiving Fines in order to take advantage of the benefits of the Amnesty program. If one or more eligible judgments are excluded, the respondent will be disqualified from participating in the Program. This agreement is expressly subject to the payment of all outstanding judgments against a respondent. This agreement shall be null and void if the respondent fails to pay any and all such eligible judgments. Further, this agreement is subject to the results of any additional searches for outstanding judgments that may be performed by the City. If the respondent is notified that additional judgments must be paid and fails to do so within the required time frame, the respondent shall not be eligible for this Program. Any amounts paid by such a respondent will be applied to the full amount owed, including all applicable penalties and interest.

Only violations that were in judgment no more than 90 days before the Amnesty Program began were eligible for amnesty. To be in judgment means that the City of New York took the legal step of filing a public record of your liability in court for the entire amount due were eligible for the program.
