Integrity Review

The Integrity Review process includes sponsor review and evaluation of compliance with Executive Order No. 50 (E.O. 50). Qualifying participants in HPD transactions must complete a Compliance Package to fulfill the requirements of the process.

The Integrity Review process is intended to verify the integrity of individuals and entities seeking to do business with HPD (e.g., as developers or contractors). Through a series of disclosure statement reviews and background checks, HPD’s Integrity Review Unit works to ensure that sponsors are honest, reliable stewards of public resources. Also, during the Integrity Review process, HPD staff analyze the physical and financial health of sponsors’ property portfolios and work with sponsors to ensure that corrective actions have been taken to address outstanding violations and arrears prior to loan closing. In addition, E.O. 50 requires that all entities entering a contractual relationship with the City, including prevailing wage and non-prevailing wage contracts, do not discriminate against employees or job applicants in any employment decisions or any other term or condition of employment.

Completing the Integrity Review process in a timely and responsive manner can reduce the risk of loan closing delays as well as project suspensions or cancellations. Incomplete submissions will not be accepted. HPD may request additional information based on its review, including corrective action taken or any issues identified with the physical or financial health of a sponsor’s property portfolio.

Sponsor Review

Developers, borrowers, prime contractors (and their owners and officers) must submit Compliance Packages for development projects, some preservation projects, and for inclusion on some Pre-Qualified Lists (including Marketing Agents and 7A Administrators). Follow the instructions throughout to determine which sections apply based on whether you are completing the package as an entity or as an individual participant (owners and officers). Contractors working through the Emergency Operations Division do not complete these documents; they go through a different review process.

Within two weeks prior to loan closing, entities are required to submit a Pre-Transaction Affidavit affirming that there have been no significant changes to the project or the sponsor's ability to proceed with the project since the completion of the Sponsor Review process.

EO-50 Review

All vendors performing work on HPD-assisted projects must meet the labor law integrity standards and equal employment opportunity requirements under federal, state and local law. For contractors who are subject to Sponsor Review, the required documents are included in the Sponsor Review Compliance Package. For everyone else, those forms are available here:

Enhanced Contractor Review

HPD maintains a list of contractors who have been placed on Enhanced Review Status. These are generally contractors who have a history of multiple or significant underpayments to workers, construction quality issues, and/or Labor Law or Construction Law violations. Contractors on this list are subject to extra pre-contract scrutiny and in-project monitoring. For detailed information about this program, see:
