Construction Embargoes

DOT imposes construction embargoes during significant special events, including the New York City Marathon, parades, and for the winter holiday season. During embargoes, all active permits in the affected area(s) are suspended and no new permits may be approved, unless a waiver for the work is granted by DOT. No Dig/Dig with Caution (Network Maintenance Work) Special Construction Embargo – Portions of the Bronx Embargo – July 30 - September 30, 2019

At the request of the New York City Department of Information Technology and Telecommunications (DoITT), a special construction embargo from Tuesday, July 30th through Monday, September 30th has been issued for any street work in the areas listed below, due to network maintenance work in progress. During this time frame, only emergency work street excavations may be performed provided an emergency number is received from the New York City Department of Transportation. Any non-emergency permits issued prior to the date of this notice are hereby suspended for the dates and locations indicated below. Utility cover openings are also restricted, unless an emergency authorization number has been obtained from the Department of Transportation. Holiday Construction Embargo – November 15, 2019 – January 2, 2020

A Special Holiday Construction Embargo shall be in effect from 6:00 am Friday, November 15th through 11:59 pm Thursday, January 2nd. During this time frame, only emergency work may be performed provided an emergency number is received from the New York City Department of Transportation. Any non-emergency permits issued prior to the date of this notice are hereby suspended for the dates and locations indicated below.  Utility cover openings are also restricted unless an emergency authorization number has been obtained from the Department of Transportation. There will be strict enforcement of this embargo and violators are subject to be summonsed.

Permit requests for construction activities during Holiday Embargo period should only be submitted for critical reasons for a specific project.

Any permits issued prior to the date of this notice, for work during this embargo period on the streets listed below which do not already have the HE permit stipulation “410” are hereby suspended for the period noted above. All permittees must comply with this embargo unless a special permission is granted by OCMC.

Prior to this embargo period all necessary measures must be taken so that all roadways and sidewalks are in proper condition to allow for the expeditious and safe movement of vehicular, bicycle and pedestrian traffic.

The opening of utility access covers is prohibited on any of the streets noted below between the hours of 6:00 AM and midnight except in cases of emergency where the utility or contractor must first obtain an Emergency Authorization Number as required by section 2-07 of NYCDOT's Highway Rules.  The planned opening of utility access covers may occur during the hours of 12:01AM and 5:59AM where no authorization number is required.

As of August 31, 2017, a new Holiday Embargo (HE) review process has replaced the previously used HE waiver request process used by NYCSTREETS.  During the application process, the NYCSTREETS system will automatically identify cases which require additional HE review, and processes them accordingly.

If a permit application includes permit requests to work on embargoed streets within 90 days prior to the start of the HE (November 15, 2018), the permittee will be presented with a warning, during the application process, stating that such permit request(s) will be subject to the upcoming HE.  If work is planned through the HE period, the critical reasons for the work must be included in the "Work Description" field of the application.

For all permit applications including permit requests to work on embargoed streets through the HE period, the permittee will be automatically charged an additional $135 HE application review fee. The HE application review fee must be paid in advance before any permit requests within a given application can be reviewed. None of the permit requests included in the application will be available for review by OCMC staff until the HE application review fee is paid. If the HE application review fee is not paid within five (5) calendar days, the entire application will be denied automatically by the NYCSTREETS system.  The HE application review fee payment does not guarantee permit request(s) approval.

Permit requests for ongoing construction (permit renewals, reissues and extensions) through the HE period, which already include HE stipulation “410” will not require payment of the HE application review fee and will be processed as usual.

Emergency permits can be submitted as usual. All emergency permit conversion applications for work during HE period will require advanced HE application review fee payment. No Emergency conversion permit request(s) will be reviewed until the HE application review fee payment is received.

All permit requests which are not subject to HE, may be submitted online, and will be processed as usual.

Please note, the deadline for submission of permit applications for work during the HE period, is Thursday, October 31, 2019.  Starting Friday, November 1, 2019, online submissions of permit applications for work on embargoed streets during the HE period will be disabled.  After the deadline, permit applications for work during the HE period can only be submitted in person, and will only be accepted under special circumstances.  In person applications can only be submitted at the NYCDOT Construction Permits Central Office at 55 Water Street, during normal window hours, Mon.-Fri. 8am-11:30am.
