Reasonable Accommodation Appeal

This portal is only to be used to appeal agency denials of reasonable accommodation requests. Initial requests must be handled at your agency. If you have not received a denial from your agency, please do not proceed here.

Per the DOHMH Commissioner’s Order to Require COVID-19 Vaccination for City Employees and Certain City Contractors, City employees are required to be vaccinated against COVID-19 by October 29, 2021 at 5 PM, or by their employment start date. Employees may apply for a Reasonable Accommodation to be exempt from this requirement. Reasonable accommodations may be granted only for documented medical or religious reasons.

This online review request portal is for City employees covered by this policy who wish to appeal their Agency’s decision concerning their request for reasonable accommodation regarding the requirement to vaccinate.  This portal is only for appeals of reasonable accommodations requesting an exemption of the vaccination requirement, not to request accommodations in the first instance.  Any other reasonable accommodation request determination should follow your agency’s customary appeal process.

Employees wishing to appeal must fill out the form using the link below within three business days of the Agency decision denying their reasonable accommodation.  The request for review must include a reason for the appeal. The agency will provide all records you previously provided to them. You may also submit additional documentation in support of your appeal through this portal.

If you requested your reasonable accommodation from your agency on or before October 27, 2021, and you opted to appeal the decision, then while your appeal is pending, you must continue to submit a negative test result within every seven day period as has been previously required.

If your appeal is denied, you must submit proof of the first dose of a vaccination within 3 business days of receipt of the appeal denial, and if part of a two-dose vaccine regimen, you must submit proof of a second dose within 45 days of receiving that second dose.

Please fill out the form using the link below to start your appeal.  You must fill out and submit the appeal form within 3 business days of the agency decision denying your reasonable accommodation.  If you do not file your appeal in this timeframe, it will not be considered. For NYPD employees and those who do not have agency e-mail, you should notify your agency EEO officer of your desire to appeal by the deadline, and the agency EEO officer will file the appeal for you.
