Interstate Compact on the Placement of Children

The Interstate Compact on the Placement of Children (ICPC) allows agencies to place children with foster parents or programs in other states. The New York State Office of Children and Family Services (OCFS) enforces the ICPC. Agents and agencies that conduct interstate adoptions or fostering must comply.



Agents must provide casework information to place a child in another state. Services in the receiving state must agree that the placement serves the child's interests.

Children can be placed in any of the fifty states, the District of Columbia, or the US Virgin Islands. Note that the compact does not permit children to be placed into foster care in Puerto Rico.
