Operating Requirements

    All operators of tanning facilities using UV equipment must comply with all requirements outlined in Article 177 of the NYC Health Code.

      All tanning establishment operators, and employees who operate a UV device, or who assist patrons in the operation of a UV device, must obtain a certificate of completion of formal training in the safe operation of a UV device by a provider approved by the City.

        Operators must provide every patron with a copy of the NYC Department of Health and Mental Hygiene (DOHMH) fact sheet about the health risks of indoor tanning.

          Annually, operators must have every patron read and sign a DOHMH Indoor Tanning Patron Acknowledgement Form. The operator or a facility employee must also sign the form. There must be a current signed acknowledgement form on file for all patrons using a tanning device.

            No one under age 17 is permitted to use a tanning machine (UV device). Operators must require a government-issued photo ID for all patrons age 18 or older. Patrons age 17 must have a consent form signed by a parent or legal guardian.

              The operator must report all injuries or illnesses occurring as a result of the use of a UV device (tanning machine) to the DOHMH Office of Public Health Engineering within 24 hours of notification of its occurrence. Reportable injuries and illnesses include eye injuries, burns and any other illness or injury for which medical care has been obtained. Operators must keep all injury reports on file for two years.

                All indoor tanning establishments must maintain a two-year running record of all of tanning device use for all patrons.

                  Each permitted tanning facility will be inspected every two years.

                    Effective June 17, 2014, establishments holding permits from the State of New York will have their permits transitioned to under the jurisdiction and oversight of the NYC Department of Health and Mental Hygiene (DOHMH). Their permits will be valid until two years from when they were issued by New York State. Upon expiration, they will renew with the DOHMH.

                        Steps to renew online:

                        You will receive a renewal notice 3 months before your permit expires. Every time you renew your permit you will need to update the device information (manifest) for all UV devices in your establishment, if applicable. If you renew online, you can enter this information when you renew your permit. If you renew in person, you must submit the separate manifest sheet you received with your renewal. Payment for the permit fee and each device must be submitted.

                          Renewals may be submitted online via the NYC Online Licensing system. Registration is required. You will not be permitted to renew a permit if you have outstanding fines. You can pay fines online before renewing.

                          To renew online for the first time, you will need the Personal Identification Number (PIN) found on your Renewal Notice for each permit or license you hold. The PIN will allow you to link your existing records to one single online account. You only need to use your PIN to link to each permit or license record once.


                          If you do not have access to your Renewal Notice, you may obtain your PIN(s) by completing an online PIN Request Form or by calling 311.

                            Renewals for this permit type are not accepted by mail. Refer to Renew Online or Renew in Person for information on how to renew.

                                You may renew your permit in person at the DCWP Citywide Licensing Center. If you send someone to renew for you, they must present an Authority to Act on your behalf.
