WHEREAS, the Sixth Assessment Report published by the United Nations’ Intergovernmental Panel on Climate Change determined that recent changes in the climate are widespread, rapid, intensifying, and unprecedented in thousands of years, and that unless there are immediate and large-scale reductions in greenhouse gas emissions, limiting warming to 1.5 degrees Celsius will be beyond reach;
WHEREAS, we have a moral, economic, public health, and security imperative to act to protect our planet, fellow human beings, and future generations;
WHEREAS, in April 2019, the City of New York published OneNYC 2050, the City’s long-term strategic plan, which included a strategy to achieve carbon neutrality by 2050;
WHEREAS, in May 2019, the City enacted Local Law 97 of 2019 (“LL97”), which included near-term GHG emissions reduction mandates for city government operations and the private sector;
WHEREAS, LL97 requires a 40% reduction in city government operations emissions by fiscal year 2025, and 50% reduction by fiscal year 2030, compared to the emissions levels recorded during fiscal year 2006; and
WHEREAS, City agencies, offices, and other entities covered under LL97 must take immediate action in order for the City to reach these goals;
NOW, THEREFORE, by virtue of the power vested in me as Mayor of the City of New York, it is hereby ordered:
Section 1. City Chief Decarbonization Officer and Agency Chief Decarbonization Officers. The business title of the Department of Citywide Administrative Services’ (“DCAS”) Division of Energy Management (“DCAS DEM”) City Chief Energy Management Officer be changed to City Chief Decarbonization Officer (“CCDO”). The CCDO will assume an expanded portfolio including overseeing compliance with decarbonization mandates for city government operations. In addition, the agencies identified by the CCDO as cumulatively contributing to more than 90% of GHG emissions from City stationary assets or as critical to meeting the City’s emissions reduction mandates will identify an Agency Chief Decarbonization Officer (“ACDO”). Each ACDO will be responsible for directing efforts to reach agency decarbonization mandates, including helping agencies access required funding and staffing, performing project identification and delivery, and conducting workforce development and change management, among other activities.
§ 2. Creation of LL97 Implementation Action Plan. DCAS DEM, in consultation with the Director of the Office of Long-Term Planning and Sustainability, or the successor to such office, or with any office designated by such director, and other City agencies, offices, and entities covered under LL97 as necessary, will develop a comprehensive Implementation Action Plan (“Action Plan”) to achieve the emissions reduction mandates for city government operations that are required by LL97. The Action Plan must be published no later than December 31, 2021.
§ 3. Establishment of Agency Emissions Reduction Targets. DCAS DEM will coordinate with all City agencies, offices, and other entities covered under LL97 to establish specific emissions reduction targets. DCAS DEM will publish a Report of City Agency Emissions Reduction Targets (“Agency Target Report”) setting such emissions reduction targets for each agency, office, or other entity covered by LL97 no later than December 31, 2021.
§ 4. Requested incorporation of emissions reductions into agency missions. All City agencies, offices, and other entities covered under LL97 are requested to incorporate into their mission a requirement to mitigate climate change by meeting or exceeding their emissions reduction targets as established in the Agency Target Report.
§ 5. Establishment of the Capital Plan Carbon Budget. Beginning in fiscal year 2023, agencies, offices, and other entities covered under LL97 will be required to report to the Office of Management and Budget (“OMB”) the emissions impacts of capital projects in City-owned buildings that are included in each year’s September Capital Plan that are valued over $1,000,000 and involve the betterment, replacement, or installation of electrical, mechanical or plumbing equipment systems, or involve substantial reconstruction of a building envelope. Agencies will report whether each covered capital project increases, decreases, or has no effect on their overall emissions, and the magnitude of the change attributed to each project. OMB will provide DCAS with the carbon impact project information reported by the agencies, to enable progress tracking toward the Agency Target Report.
§ 6. Required emissions reduction progress reporting. Beginning in calendar year 2022, the City will annually report each agency's emissions reduction progress on the City’s website.
§ 7. Effective Date. This order shall take effect immediately.
