We have implemented LGBTQAI+-specific policies to include best practices designed to overcome the severe and widespread bullying, harassment, and discrimination LGBTQAI+ young people experience at home, in school, and in their communities.
ACS’ main LGBTQAI+ policy, Promoting a Safe and Respectful Environment for LGBTQAI+ Youth and their Families Involved in the Child Welfare, Detention and Juvenile Justice Systems (2012) describes ACS’ commitment to provide all young people and families served by ACS and our contracted provider agencies with a safe, healthy, inclusive, affirming, and discrimination-free environment.
The Non-Discrimination Policy, Youth and Families (2008) prohibits discrimination on the basis of race, ethnicity, creed, color, age, sex, national origin, religion, marital status or partnership, mental or physical disability, gender identity, gender expression, sexual orientation, veteran status, alienage and citizenship status.
The Provision of Non-Medicaid Reimbursable (NMR) Treatment or Services for Youth in Foster Care (2015) policy applies to medical or mental health treatment or services that are not Medicaid reimbursable, including gender affirming healthcare associated with Gender Identity Disorder.
The supplemental guidance summarizes how provider agencies can request ACS to review, approve, and reimburse transgender-related healthcare that is categorically excluded from New York State’s Medicaid coverage. This guidance specifically includes “gender affirming healthcare associated with Gender Dysphoria,” also known as trans-related healthcare, as one of the conditions for which the NMR Policy may be utilized.
