Proposed Rule re Sexual Abuse and Sexual Harassment

Anyone who wants to comment on the proposed rules at the public hearing must sign up to speak. You can sign up before the hearing by calling 212-669-7900. You can also sign up in the hearing room before the session begins at 1:00 p.m. on July 26, 2016.
Please tell the Board of Correction if you need a reasonable accommodation of a disability at the Hearing. Please tell us if you need a sign language interpreter. You can tell us by mail or by telephone at 212-669-7900. Please tell us by the close of business on July 19, 2016.

Q: Will the Board impose a time limit on individuals who sign up to speak at the hearing? If so, what will the time limit be?

A: The time limit at the July 26, 2016 hearing will be four minutes per person.  Because of the anticipated number of commenters, time limits will be firmly enforced and the Board reserves the right to further reduce these time limits.

Q: Will all Board members be expected to attend the entirety of the hearing?

A: Board members are scheduled to attend this hearing but depending on the length of the hearing all may not be able to stay for its entirety. All Board members will review the full transcript or video.

Q: Will the Board allow the hearing to continue until everyone has had an opportunity to speak? Or is there a time at which the hearing will be terminated?

A: The hearing will continue until everyone has had an opportunity to speak. On July 26, 2016, the hearing will begin at 1 PM and end at 6 PM. However, if there are speakers signed up who have not yet spoken by 6 PM, they will be scheduled for a continuation of the hearing to occur at a later date. If it is necessary to continue the July 26 hearing on a later date, the continuation date and time will be announced via email to interested parties and on our website.

Q: What accommodations has the Board made to allow for working people and youth in school to participate in the public hearing?

A: We scheduled the July 26 hearing to begin at 1 PM expecting it to run through some of the evening and thus accommodate both people who are available during the day time and others only available after school or work. The hearing on July 26 will end at 6 PM, but if there are still people signed up who have not had the chance to speak at that time, the hearing will be continued at a later date.

Q: Has the Board posted information about the hearing throughout the jails, in each law library, and in all of the visit areas?

A: DOC has been asked to post, by July 22, information about the proposed rule and the hearing in each housing area’s dayroom and each facility’s visit area waiting room and to make available the full text of the proposed rule in each facility’s Law Library and Deputy Warden of Administration Office. The notice to be distributed throughout the jails is available here (for inmates) and here (for staff).

Additionally, the Board has extended the deadline to provide public comment to August 31, 2016 and added an option to provide comment via the Board’s voicemail system.  You can now call 212-669-7900 and leave a voicemail with your comment. Please note that the content of your call will be distributed to Board members and published on the Board’s website. Like all calls to the Board of Correction, this call is free and not recorded by DOC.
