Owner Project Requirements: Curb Cut


As of August 28, 2017, it is mandatory to submit all curb cut filings in DOB NOW: Build.


Work you can do without a permit, Licensed Skilled Tradesperson, Licensed Contractor, or Registered Design Professional

No Curb Cut installation or construction work can be performed without a Registered Design Professional submitting drawings and obtaining approval, or without a Licensed Contractor and obtaining a permit from the Department of Transportation (DOT).


No permit, but work requires a Licensed/Registered Contractor

No Curb Cut installation or construction work can be performed without a Registered Design Professional obtaining approval and without a Licensed Contractor obtaining permits from the Department and/or the Department of Transportation (DOT). However, related sidewalk repair work which is less than 25 square feet (s.f.), where the purpose is not to remove a violation, does not require a DOT permit per Title 34 DOT Highway Rules Section 2-09. Such minor repair work would be comparable to an ordinary repair, as described in AC 28-105.4.2.


When you need to hire a professional and obtain a permit

No Curb Cut installation or construction work can be performed by a Licensed Contractor without the Owner first hiring a Registered Design Professional to prepare and submit construction plans for approval by the Department. A Licensed/Registered Contractor may directly obtain a permit from the Department of Transportation for minor repair work, such as the reconstruction or repair of a sidewalk where the purpose of the work is to remove a violation.


When you need to hire a Registered Design Professional or a General Contractor to obtain a permit

A Registered Design Professional must submit construction plans for approval by the Department in order to obtain a work permit, including all necessary details as dictated by DOT requirements and guidelines.

Permits are generally tied to scope of work and work type, and are regulated according to the nature of the work, licensing, and registration requirements.
