NYC Department of Consumer and Worker Protection (DCWP) is responsible for issuing Final Agency Decisions after the NYC Office of Administrative Trials and Hearings (OATH)’s Trials Division issues a Recommended Decision. DCWP reviews the matter, including the trial transcripts, evidence presented at trial, OATH’s Recommended Decision and any post-trial written arguments, and then issues its Final Agency Decision, adopting, reversing, modifying, or sending back to OATH – in whole or in part – for further proceedings, OATH’s Recommended Decision.
