FAQs About Additional New York State Child and Earned Income Tax Payments

If you were eligible for the New York State Earned Income Tax Credit (NYS EITC) or the Empire State Child Tax Credit in tax year 2021, you may receive the Additional New York State Child and Earned Income Tax Payments this fall.

 

How does the payment work?
Filers who submitted their returns (form: IT-201) or a valid extension of time to file (form: IT-370), by the April 18, 2022, deadline and, were eligible for the NYS EITC and the Empire State Child Tax Credit, may receive payments starting in September 2022. One payment will be sent to filers which will combine the amounts from both credits. The payment will be sent as a check by mail.


Who is eligible?
Anyone who filed a 2021 New York State tax return or filed a valid extension on time and received the Empire State Child Tax Credit or the NYS EITC, including the Noncustodial Parent New York State Earned Income Credit, may qualify to receive a payment.


When will payments be issued?
The mailing of the payments will begin in late September 2022 and continue through December 2022.


How much should I expect?
For the New York State Earned Income Tax Credit, payments will be 25% of the filer’s initial credit.

For the Empire State Child Tax Credit, the payment value can be calculated in two ways. Using the first calculation the credit value depends on your income. Using the second calculation method, you will receive $100 per child. This second method will automatically be used if it generates a larger credit value. By law, the New York State Department of Taxation and Finance can only issue payments of $25 or more. If the value of your payment for either credit is less than $25, your check will not include it even if the combined amount of both is $25 or more.


Is there anything I should do?
If you qualify for one or both payments, you don’t need to do anything unless your address has changed. The New York State Department of Taxation and Finance will automatically calculate the total payment and mail you a check.
