Immediate Suspension of Non-Essential Active Asbestos Projects

In response to the Governor’s revised executive order 2026 (“Executive Order”), for construction projects identified as “Non-Essential,” Asbestos Abatement Contractors should to take the following steps to ensure that active asbestos projects are shut down in a safe and orderly manner. All non-essential asbestos projects that have not started should be postponed. The Asbestos Control Program (ACP) will initiate the following actions today:

  • ACTIVE Non-Essential ACP-7 Projects: As identified by the Executive Order, non-essential active asbestos projects should be completed within 24–72 hours in accordance with the project’s approved contingency plan or a COVID-19 Suspension Plan. If there are multiple work areas, complete the work area that you are currently working on. Do not start another work area. Submit a partial closeout (ACP-15) for the completed work area and put the project on postponement.
  • CURRENT Non–Essential ACP-7 Filings: Projects which have not started should be postponed.
  • NEW Essential ACP-7 Filings: The ACP will only accept new ACP-7 Filings for essential construction in accordance with the Executive Order.
  • EMERGENCY Filings: The ACP will only process emergency filings related to service disruption, (water service line breaks, boiler outage, and debris clean-up) or for government facilities providing emergency services for COVID-19.

The ACP Office is currently closed to the public, but we will continue program operations. ARTS and artsfeedback@dep.nyc.gov will continue to operate. The ACP office will work with the regulated community to safely bring projects to closure in a safe and orderly manner.

For projects that do not currently have an approved contingency plan and cannot partially or entirely close out with an ACP-15:

  1. download the COVID-19 Asbestos Project Worksite Closure (Scope of Work), and then
  2. submit your COVID-19 Asbestos Project Suspsension Plan (Worksite Closure Scope of Work) to covid19asbestos@dep.nyc.gov.
