Emergency Repair Program

When residential owners do not timely correct violations, HPD may take action to correct the conditions through HPD’s Emergency Repair Program (ERP). HPD and contractors retained by HPD may conduct repair work to address HPD class "C" immediately hazardous violations and Orders, as well as NYC Department of Buildings (DOB) Orders and Declarations of Emergency and referrals of certain elevator violations, NYC Department of Health and Mental Hygiene (DOHMH) Commissioner’s Orders, and violations of other housing related conditions. All expenses incurred by HPD for repair work orders issued by HPD are charged to the premises where it occurs. The City of New York (the City) is subject to laws governing procurement, contracting, and wages that may make such work performed by a contractor retained by HPD significantly more expensive than the price the owner could obtain independently for timely performing the needed remedial repair work. The City will bill the property owner through the NYC Department of Finance (DOF) for the cost of the HPD repair plus related fees and/or for all expenses incurred by HPD for any initial steps taken to attempt to make repairs if work is not able to be fully completed by HPD or its contractor. Any HPD repair charge that is billed by DOF and is past due and unpaid for, constitutes a tax lien against the property. This tax lien will bear interest and, if it remains unpaid, may be sold and/or foreclosed upon by the City to collect the amount owed.

Avoiding Emergency Repair Charges

For HPD violations and Orders, property owners can avoid HPD repair and service charges being billed to them by DOF and remove the violation(s) and Order(s) from HPD records by timely correcting the violation(s), timely correcting all conditions identified to need correction by any HPD Order, and timely certifying all such correction to HPD. For any violation or Order issued by another City agency, property owners can avoid HPD repair and service charges being billed to them by DOF by timely complying with the Violation and/or Order, as directed by the issuing agency.

Active HPD Repair Work Orders

Work orders that have been issued by HPD that have resulted or may result in associated repair charges are listed on HPD’s Building Charge Report, which is publicly available on . Work orders that are in progress and may result in future repair charges being billed to the premises (active repair orders) are among the HPD work orders that can be found using . After entering the property address, select the Charges tab, where you may see an active work order(s) for work that has not been invoiced yet related to ERP, the Alternative Enforcement Program (AEP) or demolition or other remedial work ordered by DOB.

If the Charge Report indicates that there is an open work order, there is no indication that such work order was canceled or voided, and a charge associated with such work order has not already been transferred to the NYC Department of Finance, please call the phone numbers below for more information about active HPD work orders:

Paying Emergency Repair Charges

Work orders for which work has already been completed and payment is pending to contractors and work orders for which contractors have already been paid and associated charges have already been transferred to the Department of Finance (DOF) for billing by DOF can also be found using HPD Online. You may see HPD charges billed by DOF for work related to ERP, the Alternative Enforcement Program (AEP) or demolition (ordered by DOB).

Repair charges including, but not limited to, Emergency Repair Charges, Demolition Charges, and Alternative Enforcement Program Charges will appear on the DOF property tax bill (also known as a statement of account). These HPD charges may be identified by DOF as Emergency Repair Program, Alternative Enforcement Program or Demolition charges. All of these charges are related to repair work that HPD arranged performance of, as described above.

You will not be able to certify the correction of HPD violations, file with HPD for a Dismissal Request Inspection or request a Violation Reissuance from HPD if there are pending charges owed to DOF related to HPD activities.
