Adult-Use Cannabis Retail Licenses

Brooklyn Community Board 4 reviews and provides advisory recommendations on applications for adult-use cannabis retail licenses.

Community Board Notification

Pursuant to Section 76 of the Cannabis Law, not less than thirty days nor more than two hundred seventy days before filing an application for licensure as an adult-use retail dispensary or registered organization adult-use cultivator processor distributor retail dispensary or an on-site consumption licensee, an applicant shall notify the municipality (Brooklyn Community Board 4) in which the premises is located of such applicant's intent to file such an application. Applicants for a microbusiness authorized to conduct retail sales of cannabis products to consumers must also complete this notification in the same manner as an applicant for an adult-use retail dispensary license.

In summation, the New York State Office of Cannabis Management (OCM) requires any establishment that is applying or an adult-use cannabis retail license within the district to notify the Community Board. Proof of the 30-day notice is to be submitted with the application.

Committee Review Process

The community board's review begins after it receives a 30-day notification form. The OCM requires the 30-day notice to be sent by certified mail, return receipt requested, overnight delivery service with proof of mailing, or personal delivery with proof of receipt.

Community Board 4 requires a separate questionnaire that must be filled out and submitted to the board to be reviewed by the Permits and Licenses Committee.

Applicants will receive notice of the meeting they are being invited to attend and should return the completed questionnaire to the board's district office no later than one week before the meeting date. Applicants that submit the questionnaire on time will be added to the agenda. Late submission or no response will result in a request for a 30-day extension to review the application at the next committee meeting. Failure to appear will result in an unfavorable recommendation. Applicants are encouraged to advise the district office of any changes to their application as soon as possible.

The board’s Permits and Licenses Committee on the second Tuesday of the month at 6pm unless otherwise announced. Committee recommendations are referred to the full board for a vote during the regular meeting on the third Wednesday of the month at 6pm, except during the summer recess in July and August. The committee requests all applicants bring 2 copies of the completed questionnaire with the following attachments:

  • a 5-block radius map of the area, indicating schools, churches, and other licensed dispensaries
  • a product type list
  • a floor plan
  • the Department of Buildings' Certificate of Occupancy or Letter of No Objection
  • any other information to help us determine whether it is in the public interest that the license be issued
