Parking Summons Recipient Bill of Rights

Members of the public who receive a New York City parking or camera violation ticket have the right to the following:

You have the right to prompt, honest, and respectful service from the Department of Finance. You have the right to easily access clear and concise information, or be appropriately referred, when contacting the Department of Finance with inquiries or service requests related to your summons.

You have the right to clear and simple parking forms, instructions, publications, notices, correspondence, and explanations of the policies and procedures of the Department of Finance.

You have the right to a clear explanation of the reasons for all Department of Finance decisions related to your summons.

You have the right to receive timely, courteous, and professional help from the Department of Finance. You have the right to write and speak to a supervisor about poor service. You have the right to an interpreter if you have difficulty speaking or understanding English in your dealings with the Department of Finance.

You have the right to pay only the amount of fines you owe, including interest and penalties. You have the right to expect the Department of Finance to apply your payments correctly. You have the right to receive a bill or statement showing the amount of parking, bus lane, speeding, and red light camera fines, including interest and penalties, that you owe.

You have the right to dispute your summons and present your defense before an impartial hearing officer. You have the right to receive a decision within a reasonable time period. You have the right to receive, in writing, a clear decision explaining the reason for the hearing officer’s determination.

You have the right to appeal the hearing officer’s decision if you disagree with it. You have the right to receive, in writing, a clear decision explaining the reason for the appeal board’s determination.

You have the right to expect that any inquiry, examination, or enforcement action taken by the Department of Finance will follow the law, respect all due process rights, and be no more intrusive than necessary.

You have the right to receive assistance from the Office of the Parking Summons Advocate if you meet its case criteria.
