LPC Rules

As of August 21, 2023, Amendments to Chapters 2, 5, 7 and 12 of title 63 of the Rules of the City of New York went into effect. These amendments concern storefronts, signage, sidewalks, HVAC, and solar panels, expedited Certificates of No Effect, master plans and district master plans, and the Historic Preservation Grant Program. Additionally, a new proposed Chapter 14 concerning public petition for rule-making has gone into effect. These changes and the new rule can be found in Title 63 of the Rules of the City of New York, which is an extensive body of rules that sets forth criteria for staff approval of certain work types as well as describing procedures and processes. The public hearing on the proposed amendments and rules was held on May 23, 2023 and public testimony was heard at that time. At a public meeting held on July 11, 2023, staff presented the proposed amendments and rules as revised in response to public testimony, and the Commission voted to adopt the rules as revised.

Proposed Rules

On April 9, 2024, LPC voted to calendar proposed amendments to Chapter 2 of Title 63 of the Rules of the City of New York, consisting of amendments relating to the installation of bus shelters. The public hearing on the proposed amendments to the rules will be held on May 14, 2024.

On February 13, 2024, LPC voted to calendar proposed amendments to Chapter 2 of Title 63 of the Rules of the City of New York, consisting of amendments to existing rules, including amendments relating to roadway and sidewalk cafes. The public hearing on the proposed amendments to the rules, originally advertised as March 19, 2024, will now be held on April 16, 2024.

The Rulemaking Process

The City Administrative Procedure Act (CAPA), Chapter 45 of the New York City Charter, establishes the procedure for adopting rules. Pursuant to Section 1043(b) of CAPA, the Commission will hold a public hearing at which the public and interested parties are invited to submit comments and testimony on the proposed rule revisions, at 9:30 am on April 16, 2024. This hearing will be held at LPC’s public hearing room on the 9th Floor at 1 Centre Street, New York, NY 10007. Participation by videoconference will be available as well. Please check the Hearings page on LPC’s website for updated hearing information, signup sheet links, the agenda and zoom instructions if available. The public hearing will provide an opportunity for the public to testify and/or submit written comments in person before the Commission.

We encourage anyone who wants to testify on the proposed rule revisions at the public hearing to sign up in advance by going to the LPC Hearings page starting on April 11, 2024. On that page you can find updated hearing information, signup sheet links, information on accessibility and accommodations, the agenda and zoom instructions. You can also sign up in the hearing room before the session begins on April 16, 2024. You can speak for up to three minutes.

After reviewing the public testimony and submitted testimony, the Commission can amend the proposed rules. A final version of the proposed rules would be presented to the Commissioners at a public meeting, where they can vote to adopt. If approved, the final rules would be published in the City Record and would become final 30 days after publication.
