The easiest way to appeal a decision is by using OATH's universal online Appeal Application form because it will send the appeal at the same time to both the Hearings Division Appeals Unit and the agency that issued you the summons. If you do not file your appeal online, there will be extra steps you need to take to file your appeal by mail.
You must submit your online appeal within 30 days of the date of the decision handed to you, or 35 days of the mailing date if the decision was mailed to you.
Please note that for decisions issued and appeals served on or after February 1, 2021, the time to file an appeal or response to an appeal is 30 days from the date of the hearing decision or service of the appeal, or 35 days if the hearing decision or appeal was mailed, as provided for in § 6 19 of the Hearing Division Rules of Practice.
For decisions issued and appeals served from Feb 19, 2020, though January 31, 2021, the time to file an appeal or response to an appeal is 60 days from the date of the hearing decision or service of the appeal, or 65 days if the hearing decision or appeal was mailed.
